Terms of Service

By accessing or using ApexForge Operations ('the Service'), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

ApexForge Operations provides AI-powered outbound email automation. The Service generates personalized cold emails, manages follow-up sequences, and detects replies on behalf of clients. The Service does not include lead sourcing — clients are responsible for providing their own lead lists in CSV format.

You agree not to use the Service to:

• Send spam or unsolicited commercial email in violation of CAN-SPAM, GDPR, or applicable law
• Upload lead lists obtained through illegal means
• Impersonate any person or organization
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to any part of the Service

You are solely responsible for ensuring your use of the Service complies with all applicable laws and regulations, including email marketing laws in your jurisdiction.

You are responsible for:

• The accuracy and legality of lead data you upload
• Ensuring recipients have not opted out of commercial email
• The content accuracy of any information you provide for email personalization
• Maintaining the confidentiality of your account credentials

Service fees are as described in your Service Agreement. Payment is due within 7 days of invoice date. Late payments may result in service suspension. All fees are non-refundable except as stated in your Service Agreement.

ApexForge Operations retains all rights to the Service, including the software, algorithms, and infrastructure. You retain ownership of all lead data and content you provide. Email content generated by the Service on your behalf is owned by you.

The Service is provided 'as is' without warranty of any kind. We do not guarantee any specific reply rates, open rates, or business outcomes from use of the Service. Results depend on factors outside our control including your target market, offer quality, and lead data quality.

Our total liability to you for any claim arising from use of the Service shall not exceed one month's retainer fee ($499). We are not liable for indirect, incidental, or consequential damages of any kind.

Either party may terminate the service as described in the Service Agreement. We reserve the right to suspend or terminate your account immediately if you violate these Terms.

These Terms are governed by the laws of India. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal remedies.

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify active clients of material changes via email.
